1. Scope:
These General Terms and Conditions (GTC) apply to all services of Yoga with Yordanka, defined as indoor, outdoor, or yoga sessions, published in the form of a timetable. The customer accepts the following terms and conditions by purchasing a “card” that entitles the holder to use one of the services mentioned.

2. Right of use
a) With the acquisition of a valid block card/time card, the customer is entitled to use the premises of the Yoga with Yordanka at the offered sessions 15 minutes before and 15 minutes after the end of the session. The customer can use the yoga studio for indoor classes to change clothes and take short showers. 
b) In principle, all services of Yoga with Yordanka are available to the customer. However, there is no legal claim to the use of services. Yoga classes have a limited number of participants. If special personal conditions are required for certain services, these must be fulfilled by the customer. If these conditions are not met, there is no obligation for Yoga with Yordanka to provide the service.
c) Participation in yoga sessions is only possible if the customer is on time and appears in the studio at the specified start time. After the start, for organizational reasons and out of consideration for other participants, no one will be admitted.
d) The customer must always behave on the premises of Yoga with Yordanka in such a way that there is no disruption to the course of the sessions, the setup of the studio is treated with care, and there is no impairment to the other participants. Absolute silence must be maintained during the yoga sessions, and any malfunction, particularly from devices, must be avoided.
The customer must comply with the instructions of Yoga with Yordanka, which specify these rules in the interest of all participants. In the event of gross violations by the customer general conditions and these corresponding instructions of Yoga with Yordanka, such as, e.g., Attacks, threats, insults, sexual harassment, theft, poor hygiene, etc., can be denied access to Yoga with Yordanka studio for the entire duration of the contract or with the expiry of open passports from the very first violation, without this leading to a reimbursement obligation.
To avoid conflicts among the participants, Yoga with Yordanka is granted the right to an orderly, undisturbed process to refuse (further) service provision without stating reasons. In this case, are still Refund unused passports (aliquot).


3. Contract types and conditions
a) Block/Time cards
The customer can choose from the following Block/Time cards:
o Single ticket
Depending on the specific pass, you can participate in a single yoga session (indoor, outdoor or online).
o 10 Classes Block Card
Eligible to attend ten classes. A credit for unused units is not possible.

To use remuneration.
Failure to use the offer of Yoga with Yordanka for reasons within the sphere of the customer that do not entitle them to extraordinary termination do not allow the customer to a reduction or recovery of his payment.
The cards mentioned cannot be extended or redeemed for cash. 
b) Prices and payment:
All prices are understood as Retail prices with 0% sales tax. Payment is made immediately upon purchase of the respective card, either online by card or by cash, at least before the start of the individual class.
c) a Limited number of participants/schedule changes:
Yoga with Yordanka classes has a limited number of participants. With many participants, Yoga with Yordanka cannot guarantee a place in a specific yoga class. The customer is required to appear punctually before each class. The participants will be considered in the order of their registration.
Short-term cancellations of yoga classes on special occasions do not entitle the customer to a price reduction or termination, provided the Yoga with Yordanka studio's schedule is mainly is observed. Thus the customer has the opportunity to switch to other open yoga classes. The same applies to changes to a timetable, which is generally at the discretion of Yoga with Yordanka. 

4. Termination for a good cause:
Without restricting the rights granted elsewhere in these terms and conditions, Yoga with Yordanka gave the customer the legal right to cancel a single ticket at any time for important reasons.

5. Yoga with Yordanka liability
The customer is advised that there are no lockers that can be locked on the premises of Yoga with Yordanka. Items brought in are left unattended in the changing room. Any valuables brought along are to be taken to the classroom. 
Yoga with Yordanka services is used at your own risk and peril.
Yoga with Yordanka is not liable for accidents or resulting physical damage to customers. Also
Yoga with Yordanka is not liable for the consequences of improperly performed exercises. In this regard, it will be referred to point 6.
The liability of Yoga with Yordanka for property and property damage is limited to willful intent and gross negligence, provided that Yoga with Yordanka has not caused any damage due to the violation of primary contractual obligations.

6. Health status of customers
With the acquisition of a passport or the conclusion of a term contract, each customer makes a binding declaration that they are physically healthy and mentally stable, can cope with the relevant physical and mental requirements, and will only participate in yoga classes or workshops in such a state. Participation in yoga classes or workshops under the influence of drugs, alcohol, or medication is not allowed.
The services offered are not a therapy or healing program. They replace no medical care or prescription of medication. Yoga with Yordanka is entitled to the customer's assessment of their state of health without triggering an obligation to check or liability for the decision denying the practice of yoga classes.
With his participation, the customer assures that he will not suffer from any contagious disease and that there are no medical reasons to prevent the yoga exercises from being performed. In case of doubt, the customer should consult a doctor. Chronic illnesses and other physical or mental sufferings that other participants influence or endanger in their yoga practice must be communicated to the course instructor before the start of each lesson. In pregnancy, the customer must obtain a doctor's approval from the customer before participation.

7. Privacy Policy
Customer data may be used to fulfil the contract for our advertising purposes used and not passed on to third parties. The customer agrees that their data are stored in the system of Yoga with Yordanka for a maximum of 10 years after the last visit to the studio. All information is treated confidentially under the applicable data protection regulations. See privacy policy
Yoga with Yordanka reserves the right to use the photos taken at yoga sessions for advertising purposes for events, Facebook, Instagram, website, other social media, or flyers. The participant informs the studio immediately to avoid being shown publicly in photos.

8. Place of jurisdiction, applicable law
Austrian substantive law applies to the exclusion of any reference norm. Unless the contractual relationship does not apply to the KSchG, it applies to all disputes between Yoga with Yordanka and the customer, have agreed as the exclusive place of jurisdiction of the competent court for 1020 Vienna.

Should individual clauses of these general terms and conditions be ineffective in whole or in part, this does not affect the effectiveness of the remaining provisions and the contract remains in principle, whereby the ineffective clause is replaced by a clause that the
The purpose of the ineffective clause comes closest to the economy. The requirement for writing is preserved by transmission as an email. If the customer has given an email address, all messages between the contracting parties can be made by email.
